These Terms of Service ("Terms") govern your access to and use of madeirafriends.org (the "Site"), the Madeira Friends community, and any programs, events, coworking, coliving, partner benefits, and services we offer (collectively, the "Services"), all operated by the legal entity identified below.
1. Operator
The Site and the Services are operated by Madeira Friends Community (legal entity holder of NIPC / VAT PT516898787), with registered address Rua dos Barreiros, 26A, 9060-397 Funchal, Madeira, Portugal. Contact: hello@madeirafriends.org.
2. Acceptance
By accessing the Site, joining the community, attending an event, booking coworking or coliving, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services.
3. Eligibility
You must be at least 18 years old to create an account, book a stay, or purchase a membership. By using the Services you confirm that the information you provide is accurate, current, and complete.
4. Community membership
Membership grants access to community channels, events, and member-only benefits described on the Site. We reserve the right to refuse, suspend, or revoke membership for conduct that is unlawful, harassing, discriminatory, abusive, fraudulent, or otherwise contrary to the spirit of an inclusive, respectful community. No refund is owed when access is revoked for cause.
5. Bookings, payments, and refunds
Pricing for memberships, coworking, coliving, events, and programs is published on the corresponding page or quote. Unless stated otherwise:
- Memberships renew on the date indicated at checkout and may be cancelled at any time, effective at the end of the current paid period.
- Coliving and coworking bookings are subject to the cancellation terms shown at the time of booking on madeiraremote.com or the relevant partner platform.
- Event tickets are non-refundable unless the event is cancelled by us, in which case the ticket price will be refunded.
- All amounts are in Euro (€) and include applicable Portuguese VAT unless explicitly marked otherwise.
6. Acceptable use
You agree not to:
- Use the Services for any unlawful or fraudulent purpose;
- Harass, intimidate, or discriminate against any other member, host, partner, or staff member;
- Damage, overload, or interfere with the Site or any related infrastructure;
- Scrape, copy, redistribute, or commercially exploit any content from the Site without our prior written consent;
- Misrepresent your identity or your affiliation with any person or entity.
7. User-generated content
By posting content in our community channels, at events, or on the Site, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating and promoting the community. You retain ownership of your content and remain responsible for it.
8. Photography and recordings
Events organised by Madeira Friends may be photographed or recorded for community and promotional purposes. If you do not wish to appear in our materials, please let the photographer or the organiser know on-site, or email hello@madeirafriends.org.
9. Third-party services and partners
The Site links to and integrates with third-party services and partner brands (including but not limited to madeiraremote.com, hubmadeira.com, madeiraonlineshop.com, techlabmadeira.com, madeiraassist.com, madeiracard.com, madeiraparadiseisland.com, and blog.madeirafriends.org). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party content or practices.
10. Intellectual property
The Site, its design, copy, photography, logo, and brand are owned by Madeira Friends and protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.
11. Disclaimer of warranties
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by Portuguese and EU law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Madeira Friends, its affiliates, partners, and staff will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for gross negligence or wilful misconduct.
13. Indemnity
You agree to indemnify and hold harmless Madeira Friends, its affiliates and staff from any claim or demand arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
14. Changes
We may update these Terms from time to time. Material changes will be flagged at the top of this page and on the Site. Continued use of the Services after the effective date of the change constitutes acceptance of the updated Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of Portugal. The courts of the District of Funchal, Madeira, Portugal have exclusive jurisdiction over any dispute, without prejudice to mandatory consumer protection rules in your country of residence.
